Greg Golding and Laura Steinke of King & Wood Mallesons consider the position of the Australian director in 2012 against the framework of the directors’ place in the regulatory enforcement environment. The purpose of this paper is not to undertake a technical legal review of the various sanction regimes that are applicable to the Australian director. Instead, the purpose is to make some practical comments on the position of the director by reference to recent litigation patterns, including class actions, civil penalty proceedings and general criminal prosecutions.
